Whangamata Golf Club
MEMBERSHIP TERMS AND CONDITIONS

 
These terms and conditions (Terms) set out the rules governing Whangamata Golf Club membership and membership payments online.
 
  1. MEMBER SIGNUP
    1. By signing up as a member, you agree to abide by the Rules and Constitution of the Club.
    2. By signing up, you authorise the club and New Zealand Golf to use your email address for email communication. You may opt out any time.
  2. BILLING CARD
    1. When you pay using your debit or credit card, the system automatically stores your credit card details to enable you to pay for the same / other services on the site. Credit card details are stored under heavy encryption by a third party payment provider, Windcave (formerly Payment Express), and not on the DotGolf system. Read the Windcave Privacy Policy here.
  3. INSTALMENT PAYMENTS
    1. If you are paying by debit or credit card, and have chosen the instalment payment schedule, you will automatically be charged monthly on your nominated billing card.
    2. If the instalment option is available and you have chosen it as the payment schedule, you agree to commit to the full term of the contract to cover the full subscription (i.e. contract cannot be cancelled before the full term).
  4. FEES
    1. You agree to pay a membership subscription fee, as set out on the club website and on the member signup or application form.
    2. If paying by debit/credit card, fees will be charged and billed to your nominated debit/credit card.
    3. If paying online through the club website, you agree to pay the applicable online transaction fee(s).
  5. OVERDUE PAYMENTS
    1. If your credit card payment or direct debit payment hasn’t been processed, we will communicate with you to settle your account, so you can continue to receive the benefits of being a Whangamata Golf Club member.
    2. It is your responsibility to keep your account in funds and to pay all of your own bank fees, including any fees which your bank charges if your account is overdrawn because of our direct debit. If any of your direct debits or credit card payments fail, we will either add the outstanding sum to the next direct debit or make additional direct debits to recover the overdue amount.
    3. If your account with us is more than 60 days in arrears, we will resign you from your Whangamata Golf Club membership, with or without notice. You will also be marked as unfinancial until you pay the outstanding amount.
  6. MEMBER BENEFITS AND CONDITIONS

  7. OUR LIABILITY TO YOU
    1. You have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Other than those rights and the rights given to you under this contract: we will not be liable to you for any direct, indirect or consequential loss or damage or injury of any kind to you or your property, however it arises. Compensation for personal injury by accident in New Zealand is covered by The Accident Compensation Act 2001;
    2. We will not be obliged to give you any refund of fees paid for your membership if you fail to use your membership or terminate early, before the end of your subscription period.
  8. MEMBER RESIGNATION
    1. If you want to resign as a member from Whangamata Golf Club, please contact the club.
    2. At any time, we can resign your membership immediately by giving you notice in writing or by email if we reasonably believe you have seriously breached an important term of this contract, including:
      1. if your account with us is more than 60 days in arrears (you will also be marked as unfinancial until you pay the outstanding amount)
      2. breaching any rules such as carrying out any illegal, offensive, or unsafe activity on the premises of any affiliated New Zealand Golf club.
      3. If we do terminate your membership under this clause because of your serious breach of this contract, we are still entitled to recover our costs and losses under this contract.
  9. CHANGES TO THESE TERMS
    1. Whangamata Golf Club may change or delete any of these Terms at any time.
    2. Whangamata Golf Club members are responsible for checking the Terms regularly to review any such changes.
    3. Continued participation in Whangamata Golf Club following the publication of any changes to the Terms confirms participants acceptance of those changes.
